Welcome to Tradewise

Thank you for using Tradewise ("we”, "us”, "our”). By accessing our service, you agree to be bound by these Terms of Service ("Terms”). If you disagree with any part of the terms, you may not access the service.

Eligibility

You must be at least 18 years of age to use this service. By creating an account or using the service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are accessing the service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Service Overview

Tradewise is a trading journal service that collects trade data from your brokers to provide you with analytics and insights to help improve your trading strategies.

Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.

Changes to Our Service

We may update, add, or remove features from the service from time to time. For minor changes we may not provide advance notice. For material changes — such as the removal of a core feature or a significant change to how the service works — we will endeavour to provide at least 30 days' notice by email or in-app notification before the change takes effect.

Data Collection and Use

You authorize us to collect trade data from the brokers you connect to your Tradewise account. We use this data to provide analytics and insights. We respect your privacy and are committed to protecting your personal and trade data in accordance with our Privacy Policy.

Cookies and Tracking Technologies

We use cookies and similar tracking technologies to track the activity on our service and hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. You consent to the use of cookies and similar technologies by us, in accordance with our Privacy Policy.

Social Sign-On

Our service allows you to sign in through various social media or social networking services such as Facebook or Google. If you decide to sign in through one of these services, we will receive public profile information and other data the service provides to us. The information we receive depends on the service and your privacy settings with them.

Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Tradewise Analytics Limited. All media, content, text and other assets that are part of our website are the exclusive property of Tradewise Analytics Limited.

Subscriptions and Billing

Tradewise may offer one or more subscription plans, which may include paid tiers billed on a recurring basis (monthly or annually). Payment is processed securely through our third-party payment processor. The available plans, pricing, and features are as described on our Pricing page at the time of purchase.

• Billing cycle: Your subscription begins on the date of purchase and renews automatically at the end of each billing period unless cancelled before the renewal date.
• Price changes: We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect. Continued use of a paid plan after a price change constitutes acceptance of the new price.
• Pre-launch pricing: Subscribers who joined under our Pre-Launch offer will not have their monthly subscription price increased for as long as they maintain a continuous active subscription. This price lock lapses if a subscription is cancelled and later restarted.
• Payment processing: Payment card details are processed exclusively by Stripe, Inc. and are never stored by Tradewise Analytics Limited.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you have already paid for.
• Refunds: Subscription fees are generally non-refundable. If you believe you have been charged in error, please contact us at support@tradewiseapp.co.uk within 14 days of the charge and we will review your request.
• Plan changes: We reserve the right to introduce, modify, or discontinue subscription plans at any time. Changes to existing plans will be communicated in advance.

Account Suspension and Termination

We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees, or engage in conduct that we reasonably believe is harmful to other users or the service. Upon termination:

• You may request an export of your trade data within 30 days of termination by contacting support@tradewiseapp.co.uk.
• After 30 days, we may permanently delete your account data in accordance with our Privacy Policy.
• If your account is terminated due to non-payment, you may reactivate it by settling any outstanding balance.

Limitation of Liability

To the fullest extent permitted by applicable law, Tradewise Analytics Limited's total liability to you for any claim arising out of or relating to these Terms or your use of the service shall not exceed the total subscription fees paid by you to Tradewise in the twelve (12) months preceding the claim.

Tradewise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, trading losses, loss of data, loss of goodwill, or any other intangible losses, whether arising from your use of or inability to use the service, even if Tradewise has been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law including the Consumer Rights Act 2015.

User Obligations

You agree not to use the service for any purpose that is illegal or prohibited by these Terms. You may not use the service in a way that could damage, disable, overburden, or impair the service or interfere with any other party's use of the service.

Automated Access and API Usage

You may not access the service through automated means (including bots, scrapers, or scripts) except where we provide an official API for that purpose. Attempting to reverse-engineer, decompile, or extract data from the service by automated means is prohibited and may result in immediate account suspension.

Amendments to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

Disclaimer for Investment Advice and Financial Decisions

We do not provide investment advice. Any financial decisions are best made by qualified financial providers. Trading carries risk of loss of capital and all financial decisions or investment strategies should be provided by a qualified financial advisor.

Disclaimer for Hypothetical Performance Results

We provide services which allow you to simulate alternative outcomes or to answer "what if" scenarios. This information is provided on a hypothetical basis and should be considered as such.

Disclaimer for Data Accuracy

While every effort is made to ensure all data on our site is accurate, there may be errors in information due to system bugs or other issues. By using our service you accept that any data we provide may have inaccuracies.

User Feedback

We welcome your feedback, suggestions, and ideas. If you choose to provide feedback, you grant Tradewise Analytics Limited a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and incorporate that feedback into the service. You are not required to provide feedback, and we are not obligated to act on it. You retain ownership of any intellectual property in your feedback, but acknowledge that we may independently develop similar ideas.

Service Availability

We strive to keep Tradewise available at all times, but we do not guarantee uninterrupted or error-free access to the service. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We shall not be liable for any loss or damage arising from service downtime or interruptions.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, internet or power outages, or failures of third-party service providers (such as cloud hosting or payment processors).

Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Before initiating formal proceedings, you agree to first attempt to resolve any dispute by contacting us at support@tradewiseapp.co.uk and allowing 30 days for a response and good-faith resolution.
